The Ras Al Khaimah Labour Court has ordered a restaurant owner to pay Dh71,529 to a former manager against pending salaries and labour dues.

Court records show that the plaintiff was drawing a monthly salary of Dh8,500 when his employment was arbitrarily terminated in June last year. Documents further stated that the eatery’s owner refused to pay him his labour dues, including the end of service gratuity.
The restaurant manager was compelled to file a lawsuit requesting the payment of Dh68,000 against six months of pending salaries, along with his labour dues, spanning end-of-service benefits, arbitrary dismissal, notice period, ticket, court charges and his advocate’s fees.
The defendant’s attorney argued that the manager’s service was terminated because of work-related criminal offences that ended up in big financial losses for the restaurant’s owner.
However, the RAK Labour Court turned down the defence lawyer's plea, stating that the manager proved he had nothing to do with the gross violations claimed by the eatery’s owner.
“These fall under the responsibility of other technical sectors which the plaintiff did not run or have any connection with,” it said.
Accordingly, the Court ordered the restaurant owner to pay the manager up to Dh25,500 against the arbitrary dismissal, equal to the remaining period of his limited contract.
However, the court refused the claimant’s request for a compensation against the notice period, which “is only applicable in unlimited contracts" — and ordered the eatery’s owner to pay the manager Dh71,529 against all his labour dues.
